1. Who we are and what these terms cover
These terms are an agreement between you and KitchensGuardian, Inc., a Delaware corporation (“KitchensGuardian”, “we”, “us”). They cover the KitchensGuardian mobile app, our backend services and our support (together, the “Service”).
By creating an account or using the Service you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.
Our Privacy Policy explains what information we collect and how we use it. Our Subscription Terms explain paid plans. Both are part of these terms.
KitchensGuardian is offered in the United States and Canada only. The app is not listed in other App Store or Google Play regions, and we do not offer the Service to people outside those two countries.
2. Eligibility
- You must be at least 16 years old to use the Service. We ask your age when you create an account.
- If you are under 18, you confirm that a parent or guardian has reviewed these terms and agrees to them on your behalf.
- You must live in the United States or Canada.
- You must not be barred from using the Service under the law that applies to you.
3. Your account
- Give us accurate information when you sign up and keep it up to date.
- Keep your password private. You are responsible for everything done through your account until you tell us it has been compromised.
- One person, one account. Do not create accounts for other people or share an account between people. Shared kitchens (section 5) are the way to share with your household.
- You can sign in with email and password, with Google, or with Apple.
- Tell us right away at support@kitchensguardian.com if you suspect someone else is using your account.
4. Subscriptions
KitchensGuardian is sold as a subscription, and an active subscription is needed to use it, apart from a first scan you can try after you sign up, before you set up your kitchen. Plans are billed through the Apple App Store or Google Play and are governed by our Subscription Terms. The plan, price and billing period are shown in the store and in the app before you buy. The app shows no ads.
A subscription covers one account and the kitchen that account owns: the owner’s active plan also covers that kitchen’s members while they use it. To create or own a kitchen, an account needs its own plan.
5. Shared kitchens
A kitchen can be shared between several accounts.
- The person who creates a kitchen is its host. The host can approve and remove members, refresh the invitation code, change the kitchen’s settings and delete the kitchen.
- Members can see and change the kitchen’s shared data: pantry items, grocery lists, item requests, recipes, meal plans and consumption data. They can see each other’s display names and roles. They never see each other’s email addresses.
- Only invite people you trust. Anyone with the invitation code can ask to join while the code is valid. Codes expire after 7 days and are replaced automatically whenever a member is removed. If the code leaks, ask the host to refresh it.
- Items, receipts and recipes you add to a shared kitchen belong to that kitchen. If you leave the kitchen or delete your account, that data stays with the kitchen and the other members, and you are removed from the member list.
- If a host deletes their account, the kitchen becomes read-only for the remaining members until one of them with their own active subscription takes ownership, which reopens it. If there is no other member, the kitchen is deleted.
- A subscription belongs to one account. If you join a kitchen whose owner has an active plan, you can use that kitchen under the owner’s plan. To create or own a kitchen yourself, you need your own plan.
- You are responsible for what you add to a shared kitchen and for how you treat other members.
6. AI results are guidance only
KitchensGuardian uses artificial intelligence to read receipts and photos, estimate expiry dates, suggest amounts and prices, and generate recipes. These results help you keep track. They are estimates and they can be wrong.
- Item names, quantities, units, prices and store details read from a receipt can be misread. Review every scan before you save it.
- Expiry dates are estimates based on typical shelf life, not on the actual food in your kitchen. They are not a substitute for the date printed on the package, for proper storage, or for your own judgement.
- Always check food yourself before eating it. If it looks, smells or tastes wrong, do not eat it, whatever the app says.
- Recipes are generated automatically. They may contain errors in ingredients, quantities, cooking times or temperatures. Follow safe cooking practices and check that meat, poultry, fish and eggs are cooked through.
- The app does not know your allergies, intolerances, medical conditions or dietary needs unless you type them into a request, and even then it may get it wrong. Check every ingredient yourself if you or anyone you cook for has an allergy or a medical dietary restriction. Do not rely on the app for allergen information.
- Price and spending figures are based on what the app read from your receipts, shown in the currency set on your account, and may be incomplete or wrong. They are not financial advice.
We do not promise that any AI result is accurate, complete or fit for a particular purpose.
7. Acceptable use
You agree not to:
- break the law or anyone else’s rights while using the Service
- upload photos or content that you do not have the right to share, or that is unlawful, abusive, hateful, sexual or harassing
- upload other people’s receipts, documents or photos without their permission
- try to access other users’ accounts, kitchens or data without permission
- probe, scan, overload or interfere with our servers, bypass rate limits, or access the Service through anything other than the official app
- scrape, copy or resell the Service or its data, including our ingredient catalog, recipes and estimates
- reverse engineer the app except where the law allows it
- use the Service to send spam or unwanted invitations
- create accounts for children below the age limit in section 2
- use the Service to build a competing product by systematically extracting its outputs
We may limit, suspend or close accounts that break these rules (section 11).
8. Your content and the licence you give us
“Your content” means the photos you upload, the receipt data read from them, your pantry, lists, recipes, meal plans, corrections, kitchen names and profile information.
You own your content. You give KitchensGuardian a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, analyse, adapt and display your content, and to share it with the service providers named in our Privacy Policy, for these purposes:
- running the Service for you and the members of your kitchens
- reading receipts and photos with AI providers
- building the anonymous shared caches, estimates, ingredient catalog and recipe pool that make the Service faster and more accurate for all users, as described in section 7 of the Privacy Policy
- improving the Service, including developing and testing our own future models and features, using only anonymised data as described in section 7 of the Privacy Policy, unless you object as described there
- keeping the Service secure and complying with law
This licence continues for anonymised shared data, and for data belonging to kitchens shared with other members, after you delete your account, as described in the Privacy Policy. It ends for your personal account data when you delete your account.
You confirm that you have the right to upload your content and that doing so does not break any law or agreement.
9. Our intellectual property
The app, its design, code, name, logo, ingredient catalog, prompts, estimates, and all content we create are owned by KitchensGuardian or our licensors and protected by copyright, trademark and other laws. We give you a personal, limited, non-transferable, revocable licence to install and use the app on devices you own or control, for your personal, non-commercial use, under these terms. You get no other rights.
Generated recipes are provided for your personal use. We do not claim ownership of a recipe you print and cook; we do not promise that generated text is original or free of third-party rights.
Feedback you send us may be used freely without obligation to you.
Copyright complaints
If you believe something in the Service infringes your copyright, send a notice to our designated agent:
Copyright Agent, KitchensGuardian, Inc., 1111B South Governors Avenue, Ste 42756, Dover, DE 19904, USA. Email: support@kitchensguardian.com, subject “DMCA”.
These details are registered with the United States Copyright Office in its Directory of Designated Agents, registration number DMCA-1082732. Your notice must include everything section 512(c)(3) of the US Copyright Act requires: identify the work, identify the material you say infringes it and where it is, give your contact details, and include the statements that section requires. We remove or disable material in response to a valid notice, we tell the person who posted it, and they can send a counter-notice if they believe it was removed in error. We may close the account of anyone who infringes repeatedly.
10. Third-party services
The Service relies on third parties, including Apple, Google, OpenAI, Railway and Open Food Facts. Their terms apply to your use of their services (for example the App Store or Google Play terms). We are not responsible for third-party services, and they may change or stop without our control.
Open Food Facts data is made available under the Open Database License (ODbL), and the individual contents of that database under the Database Contents License. We credit Open Food Facts in the app, with links to these licences: on the Home screen, open the menu and choose Data sources. We use the data to look up products for you; we do not publish or license a database built from it.
11. Termination
- You can stop using the Service at any time and delete your account in the app or by email (see our Account Deletion page). Deleting your account does not cancel a store subscription; cancel it in the App Store or Google Play first (see our Subscription Terms).
- We may suspend or close your account if you break these terms, if we must do so by law, or if we stop providing the Service. Where reasonable, we will warn you first.
- We may stop, change or discontinue any part of the Service. If we shut the Service down, we will give reasonable notice where possible and allow you to request a copy of your data.
- On termination, your licence to use the app ends. Sections 6, 8 (for anonymised and shared-kitchen data), 9, 12, 13, 14 and 15 continue.
12. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, non-infringement and accuracy.
In particular, we do not promise that:
- receipt readings, expiry estimates, quantities, prices or recipes are accurate (section 6)
- the Service will prevent food waste, food spoilage, food poisoning or overspending
- the Service will be uninterrupted, secure or error-free
- push notifications or reminders will arrive on time or at all
Some jurisdictions do not allow certain warranty exclusions. Where that applies, the exclusions apply only so far as the law permits. If you are a consumer, you keep the rights your own law gives you. In Canada that includes the implied conditions and warranties in your provincial consumer protection law, including the warranties in Quebec’s Consumer Protection Act that goods and services must be fit for the purpose they are bought for and must match the description given of them. In California it includes your rights under the Song-Beverly Consumer Warranty Act. Nothing in these terms reduces those rights.
13. Limitation of liability
To the fullest extent the law allows:
- KitchensGuardian, its officers, directors, employees and contractors are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, goodwill or food, arising from your use of or inability to use the Service, even if we were told it could happen.
- Our total liability to you for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim or (b) USD 100.
- Nothing in these terms limits or excludes liability that cannot be limited or excluded by law. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, and any liability under mandatory consumer protection law where you live. If you are a consumer in Canada or in a US state whose law does not allow a limit of this kind, the limit applies only so far as that law allows. If you are in Quebec, nothing in this section excludes or limits our liability for bodily or moral injury, or for an intentional or gross fault, as article 1474 of the Civil Code of Quebec provides.
14. Indemnity
If you are not a consumer, you agree to defend and compensate KitchensGuardian against claims, losses and reasonable costs that arise from your content or your breach of these terms. If you are a consumer, this section does not apply to you.
15. Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. If you are a consumer in Canada, you also keep the protection of the mandatory laws of your province, and you may bring claims in your local courts. If you are in Quebec, article 3149 of the Civil Code of Quebec lets you bring a claim before the Quebec courts whatever this section says.
Before starting any formal proceeding, you agree to contact us at support@kitchensguardian.com and give us 30 days to try to resolve the problem informally. We will do the same before bringing a claim against you.
If we cannot resolve it informally, claims will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction, except where mandatory consumer law gives you the right to sue where you live.
Nothing in this section stops either of us bringing a claim in a small claims court.
We do not require you to settle disputes by arbitration, and nothing in these terms asks you to give up your right to take part in a class action.
16. Changes to these terms
We may change these terms as the Service changes. We will post the new version in the app and on our website with a new “Last updated” date. For significant changes, we will notify you in the app or by email at least 30 days before they take effect, unless the change is required by law or is needed to address a security issue. If you keep using the Service after the effective date, the new terms apply. If you do not agree, stop using the Service and delete your account.
17. General
- These terms, the Privacy Policy and the Subscription Terms are the whole agreement between you and us about the Service.
- If part of these terms is found unenforceable, the rest still applies.
- If we do not enforce a right, we have not given it up.
- You may not transfer your rights under these terms. We may transfer ours to a successor or affiliate, and we will tell you if we do.
- Apple and Google are not parties to these terms and have no obligations to you under them. Apple and its subsidiaries are third-party beneficiaries of these terms for apps on iOS and may enforce them against you.
- For apps downloaded from the App Store, Apple’s Licensed Application End User License Agreement at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ applies in addition to these terms, and where the two conflict, Apple’s terms govern the licence to use the app. Apple has no obligation to provide any maintenance or support for the app. Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, any claim that the app does not conform to a legal requirement, and any claim under consumer protection or similar law. If a third party claims the app infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
- Notices to you may be sent to your account email or shown in the app. Notices to us go to support@kitchensguardian.com.
